CAS Releases Explanation of Vuskovic Suspension
Four weeks after the announcement of the doping suspension against HSV defender Mario Vuskovic for four years, the Court of Arbitration for Sport (CAS) has now published the official explanation. The document spans 70 pages and includes a total of 318 subpoints.
Mario Vuskovic, the 22-year-old Croatian player, had initially been banned for two years by the German Football Association’s sports court following a positive test for EPO doping in September 2022. Both the player and the National Anti-Doping Agency (NADA) and World Anti-Doping Agency (WADA) had appealed this decision: Vuskovic sought acquittal, while NADA and WADA argued for the standard four-year ban for such an offense.
Despite Vuskovic’s continued claims of innocence and the presentation of a polygraph test, the CAS did not consider these allegedly exonerating factors. Canadian chemist David Chen’s assertion that the urine sample taken immediately after an intense training session could have affected the test results was not deemed significant by the court.
The CAS ruling specifically states under point 271, „The polygraph test has no practical impact on the process.“ Additionally, the support from HSV’s medical expert Dr. Wolfgang Schillings, who documented that there were no significant changes in the player’s blood values around the time of the positive test, was dismissed as a „private test“ under point 264.
The critical statement is highlighted in the explanation under point 275: „The judges are firmly convinced that the athlete committed an anti-doping rule violation.“ The court upheld the scientific reliability of NADA and WADA’s imaging SAR-PAGE method, which was challenged by Vuskovic and his legal team.
Vuskovic will only be eligible to play again in November 2026, after serving his four-year suspension. HSV has terminated his contract, which was valid until 2025, but has offered him a new performance-based agreement upon the completion of his ban, providing him with the opportunity for a comeback in professional football.
Solidarity from HSV Fans
Despite the suspension, Mario Vuskovic has received numerous expressions of solidarity from HSV fans. The support from the club’s supporters has been unwavering, showcasing a sense of loyalty and understanding towards the player during this challenging time.

The case of Mario Vuskovic has sparked debates within the medical and legal communities regarding the use of polygraph tests and the interpretation of scientific data in doping cases. The conflicting opinions presented by experts have raised questions about the reliability of certain testing methods and the validity of evidence in anti-doping proceedings.
